You agree that the terms of this Agreement are severable. If any term or provision is declared invalid or unenforceable, that term or provision will be construed consistent with applicable law as nearly as possible to reflect the original intentions of the parties, and the remaining terms of the Agreement will remain in full force and effect.

OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THE SITE OR THE SITE CONTENT IS LIMITED TO ONE HUNDRED SINGAPORE DOLLARS (SGD $100.00). NEITHER FOREVERSPREE NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SITE SHALL BE LIABLE FOR ANY INCIDENTAL, SPECIAL, CONSEQUENTIAL OR INDIRECT DAMAGES RESULTING FROM YOUR ACCESS TO, OR USE OF, OR INABILITY TO USE THE SITE AND THE SITE CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE KNOW OF THE POSSIBILITY OF SUCH DAMAGE.

Neither ForeverSpree nor its affiliates will be responsible for delays or any failure in performance under these Terms and Conditions, where performance is made commercially impracticable due to circumstances beyond either party’s control including, but not limited to: the failure of any server hardware or software to operate or function property; the inability to link to, access, conduct business or confirm transactions on or through the ForeverSpree Web site whether caused by server hardware or software failure or caused by any Internet service provider or other third party; earthquake, flood, fire, storm or other casualty or natural disaster; epidemic; accident; explosion; act of God; lockout; strike; labor controversy or threat thereof; riot; insurrection; civil disturbance or commotion; boycott; disruption of the public markets; war or armed conflict (whether or not officially declared); sabotage; act of a public enemy; embargo; delay of a common carrier; the inability to obtain sufficient material, supplies, labor, transportation, power or other essential commodity or service required in the conduct of its business; lack of availability of any product or service advertised or promoted on the ForeverSpree Web site; or any change in or the adoption of any law, ordinance, rule, regulation, order, judgment or decree binding on such party; provided that the party relying upon this Non-Performance provision takes all steps reasonably necessary under the circumstances to mitigate the effects of the event or circumstances causing the non-performance.

All items purchased through ForeverSpree are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

ForeverSpree will not be responsible for the following (including but not limited to) :

1. The Merchant ships wrong/damaged items.

2. Missing Mails sent through normal postage mails.

3. Lost concealed cash or missing parcels.

Your correspondence with merchants or advertisers found on the Site, including payment and delivery of related goods or service, and any other terms, conditions, warranties or representations associated with such dealings, are solely between You and such merchant or advertiser. You agree not to hold ForeverSpree liable for any loss, damage, cost or expense of any sort incurred as the result of any such dealings or as the result of the presence of such merchants or advertisers on the Site.

You agree not to do any of the following while using the Site:

– violate any applicable law, statue, ordinance or regulation;

– post or transmit any Content that is unlawful, untrue, harassing, libelous, defamatory, abusive, tortuous, threatening, harmful (including but not limited to viruses, corrupted files, or any other similar software or programs) or otherwise objectionable;

– access, temper with or use of non-public areas of the Site. Unauthorized individuals attempting to access these areas of the Site may be subject to prosecution;

– gather and use information, such as other user’s names, real names, email addresses, available from the Site to transmit any unsolicited advertising, “junk mail”, “spam”, or “chain letter;”

– impersonate or misrepresent Your affiliation with any person or entity.

You may not use this site unless you are at least 13 years old.
